Is new anti-illegal immigrant measure legal? Columbia County commissioners ask court to decide

Columbia County commissioners have asked the courts to decide if ballot Measure 5-190, the anti-illegal immigrant measure that passed Nov. 4 with 57 percent voter approval, is legal and enforceable.

The county filed for a Petition for Validation of Local Government Action with the Columbia County Circuit Court on Nov. 10 regarding the proposed county ordinance that would enforce Measure 5-190, which punishes business owners – particularly general contractors and subcontractors – in Columbia County who hire undocumented workers.

The courts will decide if any or all of the measure is legal and able to be enforced by the county.

A report filed two months ago by the county’s legal counsel cautioned commissioners that Measure 5-190 and the similar ballot Measure 5-191, which didn’t pass, were poorly written and unlikely to survive legal challenges.

Any person interested in contesting “the legality, validity and effect” of the county’s proposed Ordinance No. 2008-06, which would enforce ballot Measure 5-190 -- in effect investigating any business owner who has a claim made against them that they’ve hired undocumented workers, as well as enforcing stop work orders and punitive fines of $10,000 for contractors or subcontractors found to have hired such workers -- must do so before Dec. 13.

A copy of the legal opinion regarding the ballot measure and the Petition for Judicial Validation are posted on the county’s Web site at www.co.columbia.or.us.

I am glad this measure passed in Columbia County. Regardless of how the legal aspect works our, I already consider this measure to be a success:


1) It tells business owners that we are watching and we care about who you employ.


2) It tells illegal aliens; "You are not welcome here".


3) Did you see the other article about the mill closing? Now unemployed local residents will not have to compete with illegal aliens undercutting the job market.

FACT: In the last 22 years, over 26 million illegals, have been apprehended, after crossing the border, into our United States.


THE PROBLEM IS: Less than 1, out of 4 illegals, are estimated to have been apprehended.


Mind boggling, isn't it.


According to the U.S. Immigration Service another 6 million illegals in our country are visa overstays. That is, they got a visa legally in their home country, they came here to visit and then they never left.


In the last 22 years, there have been another 4 million anchor babies born to illegals. Anchor babies are now being born at a rate of 350-400 thousand per year in our United States. All at our expense!!


Then the ANCHOR BABIES qualify for welfare, food stamps, section-8 housing, all at our expense.


American Taxpayers are getting screwed, over, and over, and over, again!!!


Each illegal immigrant, on average, costs taxpayers $9,000 PER YEAR, over, and above, anything they might contribute in taxes!!!

As a legal immigrant who used to prepare amnesty and other immigration applications, I wish to start by pointing out that the word "anti-illegal immigrant" in your title should be replaced with "anti-illegal immigration."


Presently, more than 10 million Americans, including Hispanics, are out of work, and the United States is bankrupt! Also, 75% of our adult cash welfare recipients are between the ages of 20 and 39. Why not enforce our immigration laws across the board and put all able-bodied adult welfare recipients and non-violent prison inmates to work in jobs held by illegal migrants?

Americans and legal immigrants should be aware that amnesty advocated by President-elect Obama and other promoters of mass immigration will add millions more jobseekers to the U.S. within years. Newcomers will also need healthcare, education and many other social services that any taxes most pay will not cover due to their low incomes.

Isn't it only responsible that Congress enacts an immigration moratorium that benefits all Americans?

Yes, and the IRRESPONSIBLE open borders/amnesty politicians have fought it for years as they pandered to cheap labor interests.

There's a Democrat crafted bipartisan bill called the SAVE Act (HR 4088) which is a national version of HB 2715 that Jeff Merkley(D) killed in the Oregon House.

Both bills are mandates for all employers to use E-Verify, the on-line employment eligibility confirmation system to screen out illegal aliens in their hiring.

BTW, it's STILL a felony to hire an illegal alien.

Arizona, Georgia, and Oklahoma HAVE E-Verify laws passed and the illegal aliens AND their families are leaving for other states that DON'T or they go home.

Merkley kept us from gaining a bipartisan sponsored E-Verify law HERE that would have:

*opened jobs for unemployed Oregonians

So much for creating jobs, eh Jeff?

*sent illegal aliens and their families packing

*forced cheap labor businesses to compete FAIRLY *reduced the burden on social service, educational, health care, and public safety infrastructures, and job markets.

Illegal aliens, their families, and many illegal alien gang members would leave if they can't make a living here.

*kept MORE money HERE in Oregon.

Overall, 20 billion dollars were sent by Mexican immigrants residing in the United States back to Mexico in 2005 (i.e., not invested in U.S. economy) a 17 percent increase from the PREVIOUS year, with an increase of 23 percent in the first half of 2006.

That's the OTHER part of the economic damage done by the hiring of illegal aliens and the violation of federal law, other than depressed wages, overburdened social services, schools, etc.

I wonder why Boise finally made the decision to pull out of Columbia County? Maybe it is just too crazy in a tough economy to do business here. Good work, Wayne and your buddies. Expect to see the unemployment rate rise. And since undocumented workers can't collect, that's your white buddies that are feeling the hit for your racist escapades.
